Time limit of assessment for year 2007-08 of some dealers enhanced in Punjab

Time limit of assessment year 2007-08 cases of certain dealers has been enhanced to six years by Excise and Taxation Department, Punjab. Ussualy time limit for assessment is three years unless extended by Commissioner. The opportunity of being heard to contest such extension order has been provided by a public notice being displayed on the official website of the Department. The question is whether such alternative service of public notice on the website is valid in view of Rule 86 of PVAT Rules, 2005 (which deals with manner of service of notice), especially when all the dealers may not be computer/internet literate.
The relevant public notice is produced herebelow: PUBLIC NOTICE EXCISE AND TAXATION DEPARTMENT GOVT. OF PUNJAB Attention: VAT Dealers / Taxable persons / Lawyers / Charted Accountants / Cost Accountants. Under Section 29 of the Punjab Value Added Tax, 2005, for the Financial year 2007-08, the department has selected some of the Taxable Dealers based on certain criteria for assessment. It is proposed to allow the conduct of these assessments for these dealers with in a period of six years from the date, when the assessee filed his annual statement. If any dealer is having any objection with regard to this allowance in extension of the date, they can represent the same personally. The venue and date for hearing any claims/objections by the Dealers shall take place as per the schedule mentioned below:- Date Division Venue 23-8-2011 Ludhaina Division at Chandigarh. 24-8-2011 Patiala Division at Patiala. 25-8-2011 Faridkot & Ferozepur Division at Chandigarh. 26-8-2011 Jalandhar & Amritsar Division at Chandigarh The list of cases has been put up on www.pextax.com for ready reference.
